Bankruptcy Judge Says Auction Of Paper Mill's Water Permits To Go On.

A federal bankruptcy judge has decided over objections from state environmental officials to continue to allow a defunct paper mill's water permits to be sold at auction.

The Durango Georgia Paper Co. mill in St. Marys went bankrupt in 2002. Last month, Judge Lamar W. Davis Jr. issued an order that included a provision to auction off its water permits.

The state Environmental Protection Division objected to the sale of the permits, saying that Durango never owned the water in the first place and that it merely had the right to use it.

Davis stuck with his decision following a hearing on the issue Friday in Brunswick. The auction is scheduled for Dec. 6. Likely bidders include developers who would put housing tracts on the land, the Savannah Morning News reported Saturday.

Bidders will have a chance to buy rights to pump up to 44 million gallons of water a day from wells, a first in Georgia. But they will be warned the state may not honor the rights.

It's uncertain how much the water rights are worth, The Atlanta Journal-Constitution reported Saturday. The state issues water withdrawal permits for free, but requires permits to limit and monitor water use.

In 2003, Georgia lawmakers fought over the issue of buying and selling water rights, ultimately defeating a bill that would have allowed water trading. Environmental groups worry that this sale of water permits could be used to try to establish precedent, or it could be used in an effort to circumvent the legislative process and get water permit trading approved in the courts.

Hardy's Rostraver Mansion Up On The Auction Block.

Malmaison Chateau, the lavish Rostraver Township home of 84 Lumber founder Joseph A. Hardy III, will be offered for sale Aug. 13 at an absolute auction -- which means there will be no minimum, and the property will go to the highest bidder. 
The 18,653-square-foot mansion, located about 25 miles from Pittsburgh, rests on 10 acres and features French Renaissance Revival decor. 

One Hardy Place contains 17 rooms, seven baths, a movie theater, solarium, cherry-paneled library, a wine collection of more than 1,000 bottles, game room, executive office and media center. 

"The opportunity to own an estate of this caliber is rarely seen in Western Pennsylvania. We think our market is local, but we also believe there is a national opportunity," said Howard W. "Hoddy" Hanna III, president of Howard Hanna Real Estate Services, the Pittsburgh-based real estate firm marketing the site. 

Hanna said only the house would be sold at the auction, and the buyer would have the first opportunity to buy the furnishings. 

Hanna said absolute auctions are somewhat rare, generally associated with high-end properties in New York or California. 

Howard Hanna Real Estate Services, an affiliate of Christie's Great Estates, will promote the event. Marty Davis of Harry Davis & Co. will conduct the auction. 

"We've enjoyed living here, and I didn't ever think I would be selling," said Hardy, 82, founder and CEO of 84 Lumber Co., which operates more than 500 stores and building-component manufacturing plants. The company posted more than $3 billion in sales last year. 

Hardy, also vice-chairman of the Fayette County Commission, currently lives in a mansion at his Nemacolin Woodlands Resort near Farmington, Fayette County. 

Hardy said he built the chateau seven years ago for about $7 million. He put the mansion up for sale in November 2003, initially asking $7 million but later reducing it to $5 million.

Auction Fees Get Capped.

DealMania (www.dealmania.com), a fast growing online auction provider, today announced it would begin capping seller fees on a monthly basis starting in August. Fee capping is a patent-pending billing process developed by DealMania specifically for online auctions. Once a seller reaches the fee cap during any given month, the items they sell will be not subject to fees for the remainder of that month. Sellers using the DealMania auction site could see significant savings when their fees reach the cap early in the month.

Jewish Congress Objects To Auction of Hitler Sketches.

The Canadian Jewish Congress is calling for a stop to an upcoming auction in Montreal of sketches by Adolf Hitler. 

Montreal auctioneer IeLgor de Saint Hippolyte plans to put four architectural sketches and two greeting cards signed by Hitler on the block July 19 and 20. De Saint Hippolyte told CBC News that the invitation-only event is expected to draw 8,000 people.

"My mandate says get me the best price for those pieces, whatever they are by Hitler, by Stalin [or] by Lenin," he said. The current owner of the six pieces chose to remain anonymous.

The four drawings in question were made in charcoal, pencil and watercolour. One includes Hilter's corrections in red pencil on sketches of the opera house in his hometown of Linz, Austria, designed by his architecture minister Albert Speer. The greeting cards date from New Year's Day 1935 and Christmas 1938.

There is a precedent for the sale of art by the German fuhrer: In the U.K. in 1997, an anonymous buyer took home a Hitler watercolour for about $9,000 | about five times greater than its estimated value.

The Canadian Jewish Congress is protesting the Montreal sale.

"For his so-called works of art, his scribblings, to become objets de commerce, or objects of trade, is absolutely incredible in this day and age," said Frank Schlesinger, a Montreal lawyer and honorary vice president of the group's Quebec chapter. 

Schlesinger, who headed the Quebec chapter of the Jewish Congress in the early 1980s, says he would not object to these types of items being placed in a museum or other similar institution for study.

"Let people who are interested in scholarly research go and take look at it, but don't profit from the sale of these objects by a madman," he said. 

Though his dream was to study art, Hitler failed twice to gain admission to a fine arts school. As a young man, he was able to scrape by through selling painted postcards and advertisements. He was a prolific artist and is estimated to have created more than 2,000 drawings and paintings.

According to a 2002 Washington Post article, there are prominent collectors of Hilter's art in the U.S., Italy, the U.K. and Japan.
